摘要
文化政策法治化是当前我国文化法制建设的重要面向,应当以宪法上文化权利的实现为依归。我国宪法上的文化权利可以概括为文化表现权、文化保障权、文化平等权、文化参与权,它们之间相辅相成,从不同的路径引领着文化政策法治化的过程。文化政策法治化应以文化表现权的践行为前提,以文化保障权的满足为内容,以文化参与权的落实为手段,以文化平等权的维护为追求,最终确保宪法上文化权利的完满实现。
The constitutional culture rights should be the purpose of the legalization of culture policies which is the important aspect of the legal construction of culture in China ＇s current situation. The constitutional culture rights contain cultural performance rights, cultural guarantee？ rights, cultural equality rights and cultural participation rights which supplement each other and lead the process of the legalization of culture policies in various paths. In order to finally achieve the realization of the constitutional culture rights, the legalization of culture policies should be on the premise of practicing cultural performance rights, for the content of satisfying cultural guarantee？ rights, by means of the implement of cultural equality rights and for the pursuit of the protection of cultural participation rights.
