摘要
生态环境损害赔偿制度是我国生态文明制度体系建设的重要内容,目前正在大力推进,但存在着法理自洽性问题。欧盟的生态损害救济经历了从民事构想到以《关于预防和补救环境损害的环境责任指令》为中心的行政救济转变,并在成员国得到了转化与实施,但受制于欧盟成员国复杂的法律体系结构,面临着与成员国既有环境法律难以协调、环境损害责任制度难以适用等困境。基于欧盟生态损害救济的实践,我国生态环境损害赔偿制度应构建以行政机制为主导的生态损害救济模式、创设规范有效的生态损害责任实体性制度、制定以修复为核心的专门立法。
Environmental damage compensation system is an important part of the construction of ecological civilization system in China,which is being vigorously promoted at present,but there are some self-consistency problems with China’s existing legal system.The EU’s ecological damage compensation has undergone a transformation from civil conception to administrative compensation centered on the instruction on environmental liability for the prevention and remedy of environmental damage.Although the instruction has been translated and implemented in member states,it is restricted by the complex legal system structure of EU member states,and it is difficult to coordinate existing environmental laws with member states and apply the environmental damage liability system.Based on the practice of EU’s ecological damage compensation,ecological environment damage compensation system should establish an ecological damage compensation mode dominated by administrative mechanism,establish a normative and effective substantive system of ecological damage liability,and formulate special legislation focusing on restoration in China.
