摘要
在基层执法中,执法者和执法对象的默契性互动是一个常见的现象。现有的研究集中在问题本身的棘手性、基层治理过程的灵活性和制度规则的动态变化等方面,鲜少关注到默契性互动是平衡多元行动者利益、化解基层矛盾纠纷、推动基层有效治理的行动策略。文章基于利益政治的理论视角,通过对A路流动摊贩治理案例的分析发现,基层执法中的默契性互动可以维持流动摊贩生计、缓解基层执法压力、化解潜在矛盾冲突和形塑街面时空秩序,构建起由国家权力主导的基层自发性治理秩序,从而推动多元行动者利益平衡,实现有效治理。默契性互动为理解改革开放以来中国社会的长期稳定奇迹提供了一种理论解释视角,也为新时期防范化解基层矛盾纠纷提供了启发与借鉴。
In urban grassroots law enforcement,the tacit interaction between law enforcers and law enforcement targets is a common governance phenomenon.Existing research focuses on the intractability of the problem itself,the flexibility of the urban grassroots governance process,and the dynamic changes of institutional rules.It rarely pays attention to the tacit interaction as an important strategy to balance the interests of multiple actors,resolve grassroots conflicts and disputes,and promote effective governance at the grassroots level.From the perspective of interest politics,through the analysis of the governance case of street vendors on Road A,it is found that tacit interaction in urban grassroots law enforcement can maintain the livelihood of mobile vendors,alleviate the pressure of grassroots law enforcement,resolve potential conflicts and shape the spatial and temporal order of the street,and build a spontaneous governance order dominated by state power at the urban grassroots level,thus balancing the interests of multiple actors and promoting effective governance at the urban grassroots level.The tacit interaction in urban grassroots law enforcement provides a theoretical explanation for understanding the long-term stability miracle of Chinese society since the reform and opening up,and also provides certain enlightenment for preventing and resolving urban grassroots conflicts and disputes in the new era.
