摘要
生态环境法律的产生和发展是法律代替环境政策的必然逻辑。我国生态环境法律从无到有、从少到多、从不完善到完善,已经形成了以宪法为根本,以环境保护法律为核心,以环境法规、地方性环境法规、部门环境规章为补充,以刑法为最终保障的比较完善的法律体系。环境立法三十多年来,国家通过推进污染治理、发展绿色经济和循环经济、实施生态建设和农村环境综合整治、开展重点领域风险防控、强制环保主体执行环境保护制度,承担环境保护责任,履行环境保护义务,生态环境法律实施成效非常显著:污染事故不断下降;公众环境诉求得到了及时解决;环境行政执法成绩斐然;环境刑事司法威慑力大增;环保督察效果前所未有。应当不断完善立法、执法和司法,使生态环境法律更好地为我国生态文明建设和高质量发展保驾护航。
Theemergence and development of the ecological environment law is the inevitable logic of law’s replacing the environmental policy.The ecological environment law in our country grows out from nothing,from less to more,and fromimperfect to perfect.It has formed a better legal system,with the constitution as foundation,the environmental protection law as the core,the environmental law,departmental and local environmental laws/regulations as supplements,and environmental regulations in the criminal law as the ultimate guarantee.Since the legislation and implementation over 30 years ago,by promoting pollution control,developing green and circular economy,implementing ecological construction and comprehensive improvement of rural environment,and carrying out risk prevention and control in key areas,by enforcing the mandatory environmental protection subject system,undertaking the environmental protection responsibility to perform the duty,fulfill the obligation of environmental protection,the implementation of ecological and environmental laws has achieved remarkable results in terms of continuously decreasing the pollution accidents,solving the public environmental appeal timely,achieving remarkably in environmental administrative law enforcement,greatly increasing the environmental criminal judicature,andunprecedentedly enhancing environmental inspection effect.We should constantly improve legislation,law enforcement and judicature so that the ecological law can better escort China’s ecological civilization construction and high-quality development.
