摘要
习近平生态法治观是习近平关于生态环境法治工作一系列重要论述的“思想荟萃”,蕴涵丰富的内在逻辑和方法论体系。从生成逻辑看,习近平生态法治观既是对中华传统生态智慧与法律制度的现代传承,又是对马克思主义生态哲学的借鉴与超越,也是对生态环境法治本土经验的科学提炼。从方法论创新看,习近平生态法治观坚持整体观方法、协同治理方法和底线思维方法,为我国生态环境法治建设提供了方法论指导。作为当下生态环境法治建设的重要内容和薄弱环节,生态环境“行刑衔接”机制建设,应当以习近平生态法治观为理论遵循和方法指引,统筹运用整体主义、协同治理、底线思维等方法论,明晰“行刑衔接”中的权力合作及制衡原理,推进“行刑衔接”程序的规范化,为生态文明建设提供强有力法治保障。
Xi Jinping’s thought on ecological legal governance is Xi Jinping’s“thought collection”of a series of important discussions on the work of the rule of law regarding ecological environment.It contains rich logical structure and methodological system.From the logic of its formation,Xi Jinping’s thought on ecological legal governance is not only the modern inheritance of Chinese traditional ecological wisdom and legal system,but also the reference and transcendence of Marxist ecological philosophy,and the scientific refinement of the local experience of the rule of law in the ecological environment.From the perspective of its methodological innovation,Xi Jinping’s thought on ecological legal governance adheres to the holistic approach,collaborative governance approach and bottom line thinking method,which provides methodological guidance for the construction of the rule of law in China’s ecological environment.As an important content and weak link in the current construction of ecological environment rule of law,the construction of ecological environment“execution connection”mechanism should take Xi Jinping’s thought on ecological legal governance as the theoretical guidance and direction.We should scientifically apply methodologies such as holism,collaborative governance,bottom line thinking,etc.,clarify the principle of power cooperation and checks and balances in the“execution connection”,promote the standardization of the“execution connection”procedure,and provide a strong legal guarantee for the construction of ecological civilization.
