摘要
用法治思维和法治方式引领社会发展是政治管理手段的巨大变革。这意味着,以"革命"方式推进社会发展意识形态的终结;以权力为主导的纵向管理模式将出现平面化趋势,公权力机关和社会组织将会依据法律相互配合相互制约,共同实施社会管理。法治思维和法治方式是建设法治国家、法治政府和法治社会不可缺少的工具,对社会管理创新以及社会转型将产生积极深远的影响。为实现社会长期稳定的发展,需要用法律限制权力的任意行使,把权力圈在笼子里面,充分发挥法律和法律方法的功能,重视法律的权威以及逻辑推理、修辞论证和理解解释等方法的作用。
It is a great transformation of the political management tools to lead social development with the thinking and action guided by law, which means the end of thinking mode to promote social development by revolution. When the longitudinal man- agement mode which administrated by power to be used widely, the public authority and social organizations will implement social management collaboratively with restrictions and co - operations under the law. As the essential tools to build the country, the government and the society ruled by law, the thinking and the action guided by law can bring positive and far - reaching impact to the social management innovation and social transformation. To achieve long - term stable development of the society, we should restrict abuse of power to fully apply of the law and legal methods with more attentions to the authority of law and the function of legal methods, such as legal reasoning, rhetoric argumentation, interpretation, and so on.
