摘要
宪法学是具有时代性、开放性与实践性的知识体系,伴随着人类文明的进程,不断回应人们对自由生活的美好期待。新冠肺炎疫情在全球的流行,对一百年来构建的国际秩序与国际关系,乃至对人类生活方式,产生了深刻而广泛的影响。当人类的生存与发展面临挑战时,构建基于宪法的社会共识与知识谱系是十分必要的。在全球范围内,人文社会科学正经历着一百年来最深刻的变化,孕育着一种新的知识革命。在百年未有之大变局下,宪法学如何履行其学术使命与责任?面对深刻的社会变革,宪法学需要反思传统的理论范式与框架,以历史眼光梳理学术脉络,寻找具有生命力的知识谱系,构建适应“后疫情时代”的新的学术范畴与范式。在世界宪法学体系的转型中,中国宪法学应主动参与全球宪法问题的讨论,善于提炼中国人民的宪法经验,为世界宪法学的发展奉献中国智慧。
Constitutional Law is a knowledge system with epochal characters,openness,practicality,which has been constantly responding to people’s expectations on free life with human civilization’s progress.The global prevalence of COVID-19 has had a profound and broad impact on international order and affairs built in a hundred years,particularly on human’s life style.When both human’s survival and development are confronted with common challenges,the social consensus and knowledge pedigrees based on the Constitution is very necessary.Globally,the humanities and social sciences are undergoing the most profound changes in the past 100 years,gestating a new knowledge revolution.How can Constitutional Law fulfill its academic mission and responsibility under the profound shifts unseen in a century?Confronted with the profound social changes,Constitutional Law needs to reflect on traditional theoretical concept and framework,tease out academic thread in historical perspective,seek for vital knowledge pedigrees,and construct a new academic category and paradigm to adapt to the“post-epidemic era”.During the transformation of the world’s Constitutional Law system,China Constitutional Law is supposed to proactively participate in the discussion on global Constitution issues,excel at extracting the Constitutional experience from Chinese people,and devote Chinese intelligence to the global Constitutional Law’s development.
