摘要
对黑社会组织这个法律概念进行科学揭示,不能局限于对相关的法律规范进行简单注解。更为重要的是,应当引入社会学理论,把它视作一个社会学范畴,对其进行社会学的、法学的双重分析,否则有失公正。本文主要以社会学为视角,揭示了该犯罪组织所应具备的若干属性:1.有机体属性;2.生存发展属性;3."文化"属性;4.目标属性;5.手段属性;6.控制属性;7."变迁"属性。同时认为,黑社会性质组织与黑社会组织是两种不同的犯罪组织。前者所具有的不完整性体现了二者质的差异。后者所具有的幼稚性体现了二者量的差异。
We should introduce sociologic ideas and regard the undersociety as one sociologic concept.At the same,the article hold that the incompleting underground organization is different from the underground organization.
