摘要
电子商务的飞速发展,一方面,有效降低了商品的流通成本,提高了整个社会的效率,同时也降低了消费者购买商品和服务的成本;另一方面,一些电子商务平台在经历了血腥残酷的竞争之后,其地位得到了强化和巩固,也逐步暴露出其为了追求利益最大化而不择手段的真实面目,采取了很多排除限制竞争的行为,中小企业和消费者对此有诸多不满,分别从理论和实践两个方面对电商平台价格垄断行为进行研究,系统梳理电商平台典型的价格垄断行为,分析这些行为产生的内因和外因,列举了上述行为对消费者、中小型创新企业、行业、社会和国家的危害,以推进中国《反垄断法》在电商平台的执法进程、维护公平竞争的市场环境、维护消费者权益。
The rapid development of e-commerce,on one hand,has effectively reduced the circulation cost of commodities,increased the whole social efficiency,and reduced the purchasing and service cost,on the other hand,several e-commerce platformswere strengthened and consolidated after severe competition,and thus exposed the essence of pursuing benefit maximization with every mean,adopting a lot of eliminating and restricting competition behaviors,which have resulted in complaints from small-and-medium size enterprises and consumers.This paper theoretically and practically studies the price monopoly behavior of e-commerce platform,systematically combs the typical price monopoly behavior,analyzes the internal and external causes,summarizes the hazard to consumers,small-and-medium size innovative enterprises,industry and society and states to promote the enforcement process of Chinese'Anti-monopoly Law',maintain fair play market environment and protect consumers’rights.
