摘要
教育强国与法治具有内生性逻辑关联,法治是教育强国的前提和基础,教育强国是法治改革的目标和方向。锚定教育强国建设目标可以刻画出我国教育强国建设过程中法治的应然样态:教育法治理念应具有鲜明政治性和人民性,彰显中国特色;教育法律制度应促进提升教育思政引领力、人才竞争力、科技支撑力、民生保障力、社会协同力、国际影响力,以实现教育“自身强”“支撑强”“影响强”的功能价值;由立法、执法、司法、守法构成的联合教育法治行动应护航教育强国高质量发展。立足于教育强国法治应然样态要求,我国教育法治建设应坚持习近平法治思想指导,加快推进教育法法典化的进程以及提升教育法治行动效能,努力开创依法治教的新局面。
There is an inherent logical connection between legal action anda powerful country of education.The legal action is the prerequisite and foundation for building a powerful education country,while building a powerful education countryis the goal and direction of the legal action.Follow⁃ing the goal of building a powerful country of education,the ideal of the legal action in the process of building a powerful country of educationin China can be depicted as follows:Its educational legal ac⁃tion concept should have distinct political and people⁃oriented characteristics,highlighting Chinese features;its educational legal system should promote the enhancement of the leading role of ideological and political education in education,the competitiveness of talents,the supporting power of sci⁃ence and technology,the guaranteeing power for people’s livelihood,the collaborative power of soci⁃ety,and the international influence,so as to achieve the functional value of“strong in itself”,“strong in support”and“strong in influence”of education;the joint educational legal actions composed of legislation,law enforcement,judicial proceedings,and law⁃abiding should safeguard the high⁃quality development of a powerful country of education.Based on the requirements of the legalideal in build⁃ing a powerful country of education,the educationallegal construction in our country should adhere to Xi Jinping’s guidance of legal philosophy,accelerate the process of codification of educational laws,as well as enhance the effectiveness of educational legal actions in order to create a new situa⁃tion of governing education according to the law.
