摘要
对于涉外法治,必须采用系统思维,结合全球法治思想和实践发展的大背景、法治中国的大趋势进行研讨,同时根据“量变—质变”“否定之否定”“对立统一”这三大规律构建涉外法治的辩证思维,即在全球变局中的中国发展、民族复兴这一奋斗进程中把握其地位与意义,在历史的波浪式前进中看到涉外法治概念的提出是法治中国的阶段性总结、反思、升华,看到涉外法治在法律制度、法律观念、法律知识、法律能力、法治人才等方面持续不断的量的积累基础上达成的质的飞跃,将涉外法治的目标、形式、内容通过中国特色与全球共识、斗争模式与合作模式、物质富足与精神富足、民族国家利益与人类共同利益、语言与行动、安全与发展等方面的对立统一而予以辩证理解。只有将涉外法治置于国际关系和国家发展、全球治理和国家治理动态发展的时空系统中辩证认知,才能更加明晰涉外法治的战略价值,确立涉外法治的建设目标与步调,贡献于法治中国的发展。
It is necessary to adopt systematic thinking for foreign-related rule of law,place it in the great background of development of theory and practice in global rule of law,recognize it in the mega-trend of China's rule of law,and construct the dialectical thinking of foreign-related rule of law according to the three laws of“mutual change of quality and quantity”,“the negation of negation”and“unity of opposites”.It requires to grasp its position and significance in the struggle process of China's development and national rejuvenation in the global change.In the wave-like progress of history,the proposal of the concept of foreign-related rule of law is a phased summary,reflection,and sublimation of the rule of law in China.China has witnessed a qualitative leap in the accumulation of foreign-related rule of law in terms of legal system,legal conceptions,legal knowledge,legal capabilities,and legal talents.The objective,form and content of foreign-related rule of law should be dialectically understood in the context of unity of opposites between Chinese characteristics and global consensus,struggle mode and cooperation mode,the material and spiritual abundance,national interests and common interests of mankind,language and action,as well as security and development.Only by placing foreign-related rule of law in the spatiotemporal system of international relations and national development,global governance,and dynamic development of national governance,and thinking it dialectically,can the strategic value of foreign-related rule of law be more clearly understood,the construction goals and pace of which be established,and it can contribute to the development of rule of law in China.
