摘要
高校学位撤销权依据教育公权力授权而成立,是由高校办学自主或依法自主管理权力派生的复合型高校自主权力。在权力的实现前提上,它以国家学位制度作为基础,是学位制度的组成部分,并因此和学位授予制度并列。在权力的实现基础上,它根据学术自主权力而明确自身的权力行使边界,并基于事实层面的高校学位自主管理权限而不断丰富、发展,并因学术自主权力的运用而明确自身的实施内容。高校学位撤销权的实施是否合法、合理需要接受司法审查和未来的复核制度或有关机关的检验。
The authority to annul university degrees in higher education institutions is established on the grounds of delegated educational public authority,stemming from the multifaceted autonomous power granted to universities for independent operation or lawful self-management.As a complex facet of university autonomy,this authority is predicated on the national degree system,serving as an integral component alongside and in tandem with the degree conferment system.In the realization of this authority,it defines its own boundaries for exercise based on academic autonomy,continually evolving and enriching itself through the autonomous management authority over university degree matters at a factual level.The legality and rationality of implementing the authority to revoke university degrees in higher education institutions necessitate scrutiny through judicial review and evaluation within the review system or relevant authorities.
