论公办教育单位监察对象的认定与范围 被引量:1

On the Identification and Scope of the Supervision Objects of Public Educational Units

摘要 公办教育单位是教育行政权的重要行使主体。《监察法》第十五条将公办教育单位中从事管理的人员及其他依法履行公职的人员纳入监察对象范围,以实现对所有行使教育公权力的人员的监察全覆盖。由于法条规定过于笼统,规范内涵不甚明了且认定标准缺失,使得监察对象的外延划定和类型化难以实现。为此,应从监察全覆盖的立法目的出发,从规范分析角度明确公办教育单位监察对象认定中核心要素的内涵,解析立法背后教育公权力行使的边界和制度逻辑,搭建以“身份+职位/职责”和“公职行为”为内容的多层次认定标准体系,以化解监察对象认定中的理论迷思和实践困境。 Public education units are the main body of the administrative power in education.Article 15 of the Supervision Law includes the administrative and other personnel performing public duties in public education units into the scope of supervision objects,so as to realize the full coverage of all of those who exercise the public power in education.Because the legal provisions are too general,the connotations are not clear and the identification standard is missing,it is difficult to identify the classification and scope of the supervision objects.Therefore,we should start with the legislative purpose of a thorough coverage of supervision,clarify by a normative analysis the connotations of the core elements in the identification of the supervision objects in public education units,analyze the boundary and institutional logic of the exercise of public power in education from the legislative perspective,and build a multi-level system of identification standard,the contents of which is“identity+position/responsibility”and“public behavior”,in order to clear the theoretical confusion and solve the practical dilemma in the identification of supervision objects.
