摘要
涉外法治是新时代中国特色社会主义法治理论,具有伟大的时代价值、丰富的理论内涵和深远的国际意义。对涉外法治的理论孵化和领域拓展是未来必经之路。鉴于医疗卫生和健康的国内发展需求和后疫情时代的国际复杂形势,现阶段有必要界定具有中国元素的涉外卫生法治意涵。涉外卫生法治既是涉外法治的属概念也是其重要组成部分。新时代的涉外卫生法治建构必须以系统且精细的理论为支撑,据此推行完善的制度范式创新,这样才能彰显出其国际张力。目前,理论界尚未关注涉外卫生法治的相关话题,缺乏其理论定位、制度范式及国际张力的全方位考量。因此,从国家核心利益的高度和远景出发,我们将要分析涉外卫生法治的可行性理论定位与正当性逻辑,剖析现有制度范式的发展困境及其创新必要性,依据可行性理论定位和创新性制度范式,积极探索涉外卫生法治的国际张力之路径。
Foreign-related rule of law is the theory of socialist rule of law with Chinese characteristics in the new era.It has significant era value,rich theoretical implications and far-reaching international significance.Theoretical incubation and field expansion of foreign-related rule of law is unavoidable in the future.Given the domestic development needs of medical care and health and the complex international landscape in the post-epidemic era,it is necessary at this stage to define the meaning of foreign-related rule of law on health with Chinese elements.The foreign-related rule of law on health is not only a subordinate concept but also an inseparable part of the foreign-related rule of law.In the new era,the foreign-related rule of law system must be supported by a systematic and refined theory,based on which a perfect institutional paradigm innovation can be implemented so that its international tension can be manifested.At present,the theorists have not paid attention to the relevant topics of foreign-related rule of law on health,so the comprehensive consideration of its theoretical meaning,institutional paradigm and international tension is absent.Therefore,from the height and perspective of national core interests,we will analyze the feasibility theory meaning and legitimacy logic of foreign-related rule of law on health,analyze the development dilemma of the existing system paradigm and the necessity of innovation,and actively explore the path of international tension of foreign-related rule of law on health based on the feasibility theory positioning and innovative system paradigm.
