摘要
城市地下空间是重要的国土空间资源,城市地下空间权是随着社会的发展在对土地立体利用过程中产生的新型权利,确权登记是城市地下空间开发利用的重要保障,对明确权利主体、促进空间有序开发利用、加强开发利用中的市场监管具有重要的作用,对完善我国的城市地下空间法律制度、优化国土空间开发保护格局、构建高质量发展的国土空间支撑体系具有重要的价值。现阶段,我国城市地下空间确权登记工作总体态势向好,但未形成成熟、完善的城市地下空间登记制度,难以适应城市土地立体开发的现代化趋势。构建我国城市地下空间权登记制度,应构建城市地下空间权登记政策法律体系,完善城市地下空间权登记技术标准体系,在此基础上,健全城市地下空间权具体权属登记规则。
Urban underground space is an important land space resource.Urban underground space right is a new right generated in the process of three-dimensional land use with the development of society.Right confirmation registration is an important guarantee for the development and utilization of urban underground space.It plays an important role in clarifying the subject of right,promoting the orderly development and utilization of space and strengthening the market supervision in development and utilization,It is of great value to improve China’s urban underground space legal system,optimize the pattern of land space development and protection,and build a high-quality land space support system.At this stage,the overall situation of urban underground space right confirmation and registration in China is good,but a mature and perfect urban underground space registration system has not been formed,which is difficult to meet the modernization trend of three-dimensional development of urban land.To construct the urban underground space right registration system in China,we should further improve the policy and legal system of urban underground space right registration,strengthen the improvement of the technical standard system of urban underground space right registration,and pay attention to solving the existing practical problems of urban underground space right registration.
