摘要
城市地下空间权是随着社会的发展在对土地立体利用过程中产生的新型权利。准确厘清城市地下空间权的内涵、性质及支配范围,对保护空间开发利用中各类权利人的各项权益具有重要作用,对构建我国城市地下空间法律制度具有重要价值。城市地下空间权的权利主体具有多样性、权利客体具有复杂性、权利内容具有特殊性、权利取得具有公示性;城市地下空间权为地下建设用地使用权,具有法律之依据,是城市发展之必然,为司法实践之所需;对城市地下空间权支配范围的确定,应综合考虑各种因素,采取实际利用与建设规划和出让合同约定相结合的标准。
The right of urban underground space is a new kind of right that has come into being in the course of the three-dimensional use of land with the development of society.It plays an important role in protecting the rights and interests of various rights holders in the development and utilization of space and is of great value to the construction of the legal system of urban underground space in China.The subjects of urban underground space right have diversity,the objects of the right have complexity,the content of the right has particularity,the acquisition of the right has publicity,and the nature of urban underground space right is established as the right to use underground construction land,which has the legal basis,is the necessity of urban development and the need of judicial practice,and various factors should be taken into account in determining the control scope of urban underground space right,and standards shall be adopted that combine actual utilization with construction plans and grant contracts.
