摘要
功利主义法学作为近代西方主要的法学流派之一,其地位和重要性自然不言而喻。作为创始人的边沁以功利主义为基础,对最大幸福原则、幸福的目标、正义观等进行的分析和建构,尽管在当时存在诸多缺陷和不足之处,甚至遭受了各方的猛烈批判和质疑,但这丝毫不影响它对稳定当时混乱的社会秩序所产生的不可磨灭的积极作用,并且对其之后的西方实证主义法学、社会法学、经济法学等各流派的思想和主张亦产生了重要影响。尤其是他提出的功利主义基本原则至今仍然在欧洲各国的政体内发挥着一定的应用价值。
As one of the major legal schools in modern West, the status and importance of utilitarian jurisprudence are naturally self-evident. As the founder, Bentham analyzed and constructed the principle of maximum happiness, the goal of happiness and the view of justice on the basis of utilitarianism. Although they all had many defects and deficiencies at that time, even suffered fierce criticism and doubt from all sides, it did not affect its indelible positive effect on stabilizing the chaotic social order at that time, and it also has an important influence on the thoughts and propositions of Western positivism law, social law, economic law and other schools. In particular,the basic principles of utilitarianism he put forward still plays a certain application value in the regimes of European countries.
