摘要
面对我国企业环境刑事合规理念尚未确立、立法依据不足、实践尝试有限和制度缺失严重的困境,可尝试用绿色治理观为其制度构建提供新视角和新思路。相应地,引入绿色法律治理能够指引和支撑企业环境刑事合规在价值理念确立、顶层制度设计和机制手段协调方面的逐步完善。申言之,基于内部治理的企业环境刑事合规制度应当包含基本规则设计、组织队伍建设和支持监督机制等内容;基于外部治理的企业环境刑事合规制度应主要包含起诉阶段检察机关主导的环境刑事合规制度和审判阶段法院主导的环境刑事合规制度,并且在分类处理、激励形式及其适用条件、合规计划制定实施及其监督、评估和验收上互相协调、形成合力。
China’s corporate environmental criminal compliance is faced with the dilemma of unstable concept,insufficient legislative basis,limited practice and serious lack of system.As a new governance concept,green governance can provide a new development perspective and thinking method.Through the innovative application of green legal governance at the legal level,it can guide and support the further development of corporate environmental criminal compliance in China in terms of value concept establishment,top-level system design and coordination of mechanism and means.According to the concept and system of green legal governance,relevant systems involved in corporate environmental criminal compliance should be categorized and constructed.Specifically,the corporate environmental criminal compliance system based on internal governance should include basic rule design,organizational team building,and support and supervision mechanisms.The corporate environmental criminal compliance system based on external governance mainly includes the environmental criminal compliance system led by the prosecutor and the environmental criminal compliance system led by the court.The two types of systems need to coordinate with each other and form a synergy in classification treatment,application of incentive forms,formulation and implementation of compliance plans,and their supervision,evaluation,and acceptance.
