摘要
深化宅基地制度改革将为乡村转型和乡村振兴提供活力。本文从权利开放与封闭的视角入手,讨论我国农村宅基地制度的变迁、绩效与改革前景;研究发现,农村宅基地制度经历了由权利开放到趋向封闭的变迁,宅基地的合法初始取得主体、宅基地的流转以及用地和数量上都受到日益严格的限制;日趋封闭的宅基地制度不能适应新情况,存在超占限不住、应批批不了、免费给不起、流转刹不停、违法管不好、数量控不下以及闲置资产不流动等突出问题,制度的公平与效率都受到极大损失;十八大以来我国迈出宅基地制度改革的实质性步伐,总体朝着"走出权利封闭、走向权利开放"的方向发展,下一步的改革应有序加大权利开放的步伐,着重显化宅基地的财产功能。
Deepening the reform of rural homestead system will provide vitality for rural transformation and rural revitalization.From the perspective of open and limited access property rights,this paper discussed the institutional change,performance and reform of rural homestead system in China.It found that the rural homestead system turned from a more opened to a more limited access regime.With the system turned more limited,it was unable to adapt to new situations.Serious problems emerged,such as over-occupancy,inadequate approval,free payment,illegal transaction,illegal land use,excessive use,and illiquidity.Since the 18 th National Congress of the CPC,China has taken substantive steps in the reform of homestead system.The overall direction is to step out of the limited access order and towards an open access order.The next step of reform should be to step up the opening of access to an orderly way,focusing on the property functions of homestead.
