摘要
尽管农村宅基地"两权分离"比农用地"两权分离"早近20年,但宅基地产权结构开放性的扩大过程却更为艰难曲折,从成员使用权看非本集体成员的获取渠道先松后紧,从流转使用权看非本集体成员多数情形下被排除在受让方之外。应以顺应城乡人口双向流动大趋势、保障外来人口居住需求为目标,有序扩大农村宅基地产权结构的开放性。宅基地集体所有权可通过置换等途径在不同集体所有权主体之间流转,宅基地成员使用权只能在本集体内部流转、但为给放活流转使用权创造条件需要进行铺垫性改革,宅基地流转使用权可通过多种途径扩大开放性。需要尽快明确农村集体经济组织成员界定办法,加快宅基地和农房的确权登记颁证,推进相关法律的立改废释。
Although the'separation of the two rights'of rural homestead is nearly 20 years earlier than the'separation of the two rights'of agricultural land,the process of expanding the openness of property rights structure of homestead is more difficult and tortuous.From the perspective of the original use right,the access channels of outsiders are relaxed and tightened.From the perspective of the successive use right,outsiders are excluded from the assignee in most cases.To expand the openness of the property rights structure of rural homestead should be in an orderly way,in order to adapt to the general trend of two-way flow of population between urban and rural areas,and to ensure the residential needs of outsiders.The collective ownership of the homestead can be transferred between the different collective ownership entities through replacement and other means.The original use right of the homestead can only be transferred within the collective,but it is necessary to create conditions for the transfer of the successive use rights.The openness of successive use rights structure of the homestead can be expanded.It is necessary to determine the methods for defining the membership of rural collective economic organizations as soon as possible,to speed up the registration and certification of the homestead and rural housing,and to promote the reform and abolition of relevant laws.
