摘要
随着电子商务交易的发展,虚假信用评价也在“与时俱进”,如虚假好评、恶意差评、反向刷单等。这些虚假的信用评价不仅损害了电商平台的信用评价机制,更是对平台内交易秩序的破坏,以及对消费者知情权、选择权等合法权利的侵害。如何对此类虚假信用评价进行有效规制?目前由于我国信用体系尚未完全建立,相关法律法规对虚假信用评价行为的认定和法律适用仍存在较多问题,以及电子商务平台内部信用评价机制的缺陷,难以对虚假信用评价行为进行有效规制。因此,需要健全信用体系,完善立法规范,并利用大数据等现代信息技术的力量健全平台内部的信用评价机制,借助多方主体的力量,共同创建并维护良好的电子商务平台信用评价机制。
With the development of e-commerce transactions,false credit evaluations are also"advancing with the times",such as false positive reviews,malicious negative reviews,and reverse orders.These false credit evaluations not only damage the credit evaluation mechanism of the e-commerce platform,but also damage the order of transactions within the platform,as well as infringe on the legitimate rights of consumers to know and choose.How to effectively regulate such false credit evaluations?At present,due to the fact that the credit system in our country has not been fully established,there are still many problems in the recognition of false credit evaluation behavior and the application of the relevant laws and regulations,and there are still many problems in the evaluation of false credits in the electronic business platform.Therefore,it is necessary to strengthen the credit system,perfect the legislation and regulations,and use the power of modern information technology such as big data to strengthen the credit evaluation mechanism within the platform.In addition,with the help of multiple parties,we will jointly create and maintain a good e-commerce platform credit evaluation mechanism.
