摘要
网络交易评价,应网络共治与信任共建而生。但虚假不实的网络评价,往往带来信任的误导。在网络交易评价中,蕴涵着丰富的权利类型:对评价消费者而言,为“言论自由权+监督权”;对潜在消费者而言,系“知情权+公平交易权”;对(平台内)经营者而言,是“自主经营权+抗辩权”;对网络平台而言,乃“信息获取权+监管权”。各方主体之间的权利冲突与博弈,广泛存在于评价消费者与(平台内)经营者、评价消费者与网络平台、(平台内)经营者与网络平台、评价消费者与潜在消费者之间。衡平网络交易评价中的权利冲突,需要借助信任协同的路径。评价消费者应合理行使权利,促进信任传导;潜在消费者应提高识别能力,善用评价机制;(平台内)经营者应禁止评价操控,共建信任体系;网络平台应适度监控与惩罚,强化第三方信任。
Online transaction evaluation is based on network co-governance and trust.However,false online evaluation often brings about misleading trust.There exist a rich rights structure in online transaction evaluation:for evaluation consumers,it is“the right to freedom of speech+the right of supervision”;for potential consumers,it is“the right to know+the right to fair trade”;for operators(on the platforms),it is“the right to independent operation+the right of defense”;for network platforms,it is“the right to access information+supervision right”.Conflict of rights and game among all subjects widely exist between the evaluation consumers and the business operators(on the platforms),between the evaluation consumers and the network platforms,between the business operators(on the platforms)and the network platforms,and between the evaluation consumers and potential consumers.It is necessary to balance the conflict of rights in the evaluation of online transactions by means of the path of trust synergy.Evaluation consumers shall reasonably exercise their rights and promote the transmission of trust;potential consumers shall improve their identification ability and make good use of the evaluation mechanism;operators(on the platforms)shall prohibit evaluation manipulation and jointly establish a trust system;network platforms shall carry out appropriate monitoring and punishment,as well as strengthen the trust in third parties.
