摘要
研究目的:分析中国耕地保护制度执行力现状,并提出相应的提升路径,为耕地保护制度落地提供积极参考。研究方法:系统推论。研究结果:基于耕地保护制度是一项关乎整个国计民生的战略全局性公共制度,以及耕地具有位置固定、可永续利用、资源稀缺的明显特征,其制度执行力有独特的形成机理,目前无论是制度的明晰力、制度的知行力,还是制度的行动力、制度的督导力都存在一定的不足之处。研究结论:要提升中国耕地保护制度执行力,应完善耕地保护制度内容体系,提高制度质量;提高耕地保护制度的社会认同度,营造执行氛围;健全耕地保护制度执行保障机制,激发执行动力;运用耕地保护现代科技手段,监督制度运行。
The purposes of the paper are to analyze the status-quo for the implementation of cultivated land protection policy in China,and to put forward the improvement path,so as to provide a reference for policy-making to upgrade the effectiveness of cultivated land protection.The normative reasoning method was employed.The results showed that based on the fact that cultivated land protection policy is a strategic and general public policy related to the whole national economy and people’s livelihood,and that cultivated land has the obvious characteristics of fixed location,sustainable use and scarce resources,its policy implementation has a unique formation mechanism.But there are certain defects in terms of the clarity,the knowledge and practice,the driving force and the supervision of the policy.Some improvement paths for the implementation of cultivated land protection policy are put forward,namely,improving the content system,the social identity,the implementation guarantee mechanism as well as using modern scientific and technological means.
