摘要
域外国家版权法等相关法律均对图书馆技术措施规避例外作出了具体的规定,这些规定有效地保障了这些国家图书馆获取作品和其他资料,促进了图书馆事业发展和社会文明进步。然而,我国版权法对此规定略显不足,给图书馆获取作品和其他资料造成了严重障碍。这就需要我们积极吸收和借鉴欧美国家的立法经验,作出类似于如下规定:图书馆只有在通过其他正当渠道无法获取作品和其他资料时,才可以采取技术措施规避例外;图书馆不得以商业目的使用技术措施规避例外;图书馆有权根据情势变化颁布临时技术措施规避例外。
Foreign copyright laws and other relevant laws have made specific provisions on the technical measures of libraries to avoid exceptions.These provisions effectively protect these national libraries from acquiring works and other materials,and promote the development of library undertakings and the progress of social civilization.However,the copyright law of our country is slightly inadequate,and the acquisition of works and other materials by libraries has caused serious obstacles.This requires us to actively absorb and draw lessons from the legislative experience of European and American and make similar provisions as follows libraries can take technical measures to avoid exceptions only when they can't obtain works and other materials through other legitimate channels;libraries can't use technical measures for commercial purposes to avoid exceptions;libraries have the right to issue temporary technical measures to avoid exceptions according to the changing circumstances.
