摘要
非法运输、走私珍贵濒危野生动物案件对野生动物侵害严重,将野生动物作为宠物饲养为该类案件常见的犯罪动机。我国国家Ⅱ级重点保护野生动物猎隼为“驯鹰”的常见涉案物种。本研究搜集整理了1993—2016年中国76起猎隼违法案件,结果表明:该类案件案发时间具明显季节性,以秋季为最高;案发地点集中于西北部,以新疆为首;走私终点集中于中东地区;走私方式从空运转为陆运、海运等方式,走私路线从北京空运至中东,转由上海、天津、浙江等多口岸转运,其陆运和海运方式则更为曲折复杂。案件交易方式由线下转换到线上,作案团伙常具外籍人员。因此,应加强重点季节和地点的阵地控制,加强外籍人员管理,并网络及物流监控等以有效防控此类违法案件。
Illegal transport and smuggling of rare and endangered wild animals seriously affect populations of wildlife.Keeping the rare and endangered wild animals as pets is often the crime motive in these cases. Falco cherrug is listed as a second-class national protected wildlife species in China and is commonly involved in crimes concerning ‘eagle training’.In this study,we collected and analyzed 76 illegal cases involving F.cherrug in China from 1993 to 2016.Occurrences of these crimes varied seasonally,and was highest in autumn.Cases were concentrated in northwest China and were most frequent in Xinjiang Uygur Autonomous Region.Most smuggled falcons were to be shipped to the Middle East.The smuggling method changed from simple airline transport to additional methods such as land and sea transport.The smuggling route to the Middle East by air shifted from Beijing to additional cities,including Shanghai,Tianjin,Zhejiang and others.The smuggling methods and routes by land and sea were more complex.Payment for these crimes changed from offline transaction to online transaction,and foreigners were often involved in criminal groups.We recommend strengthened control in key seasons and at key places,strengthened management of foreign personnel,and strengthened monitoring of networks and logistics to effectively control such illegal cases.
