摘要
关于婚外同居补偿行为的性质及效力,法学理论界对其认识殊不一致;对婚外同居补偿行为引发的财物纠纷,司法裁判结果也大相径庭,有的判决婚外同居补偿行为无效,受赠人须返还全部受赠财产;有的判决补偿行为有效,受赠人无须返还受赠财产;有的判决婚外同居补偿行为部分有效,受赠人须返还部分受赠财产等。婚外同居引发的矛盾纠纷,须重新审视婚外同居补偿行为的性质及效力,并视不同案件的具体情况,创造性地吸收和运用不法原因给付、自然债及无效法律行为等制度解决。
The legal theory community has different understandings on the nature and effectiveness of compensation for extramarital cohabitation. Judicial practice shows very different results for property disputes caused by compensation for extramarital cohabitation. Some judgments argue that the compensation for extramarital cohabitation is invalid, and the recipient shall return all the donated property;some judgments affirm the validity of the compensation, and the recipient does not need to return the donated property;and some judgments declare the partial effectiveness of the compensation for extramarital cohabitation, and the recipient shall return some of the donated property. To solve the contradictions and disputes caused by cohabitation in extramarital affairs, it is required to re-examine the nature and effectiveness of the compensation for extramarital cohabitation, and creatively absorb and apply unlawful causes, natural debts and invalid legal acts, depending on the specific circumstances of different cases.
