摘要
修订后的刑事诉讼法司法解释,将死亡赔偿金从刑事附带民事赔偿范围中剥离出来,损害了刑事被害人及其亲属的合法权益,背离了我国的优良司法传统。借鉴我国元代烧埋银制度的实践经验,应将死亡赔偿金重新纳入赔付范围。设立刑事被害人国家救助专项基金,纳入地方财政预算。实行当事人和公益组织之间的"双向互动"救助模式,激发公益组织参与救助的灵活性。发挥司法机关联接被害方与救助机构之间的桥梁纽带作用,尽到告知权利、审查核准、代为传达等义务。设立全国性的被害人援助机构,帮助被害人参与诉讼、预防和减少犯罪,并对特殊的被害人群体给予重点保护。鼓励服刑人员以部分服刑期间的劳动所得履行赔偿被害方,最大限度实现对刑事被害人的权利保障。
In the judicial interpretation of revised criminal procedure law,the death compensation spuns off from the scope of criminal incidental civil compensation,and damages the legitimate rights and interests of the criminal victims and their relatives,which deviates from the countrys judicial tradition of excellence.We should take the practice experience of Shaomaiyin system of Chinese Yuan dynasty,and then reintegrate the compensation.The state special rescue fund for criminal victims should be incorporated into the local budget.We will implement the“two-way interaction”rescue model between the parties and public organizations,and stimulate the flexibility of public organizations to participate in the rescue.The role of the bridge between the victims and the aid agencies of the judicial organ shall be used to inform the rights,review and approve,and carry out such obligations.The establishment of a national aid agency for the victims will help the victims participate in litigation,prevent and reduce crime,and give priority to protection of special victims.We will encourage prisoners to pay compensation to the victims in part of their prison term,and to maximize the protection of the rights of the criminal victims.
