食品安全监管机制创新研究——基于社会共治视角下的食品安全监管主体模式构建 被引量:10

Research on Innovation of Food Safety Supervision Mechanism——Based on the construction of the main body of food safety supervision from the perspective of social co-governance

摘要 新食品安全法的出台实现了我国食品安全监管体制由"分段监管为主,品种监管为辅"向"监管职权归一集中的大部制式"转变。多元主体有序参与的社会共治理念要求,在政府部门的适度引导下,形成以"客体导向"原则为核心的资源高效配置、风险有效管控的食品安全保障格局。但现阶段,作为食品安全监管重要角色的食品行业协会,其固有体制设置与运作模式却无法适应新环境下多元社会治理的发展要求。结合我国食品安全监管体制的变革,分析统合监管体制下所蕴含的表源与根源矛盾,并立足于该组矛盾的对立统一关系,对社会共治过程中政府与行业协会成员的行为选择加以判断,进而从多角度对新形势下食品安全监管主体模式的构建提出了建议。 The promulgation of the new Food Safety Law has realized the transformation of China's food safety supervision system from " segmented supervision,supplemented by variety supervision" to " centralized supervision of the majority system". The concept of social co-governance with orderly participation of multiple subjects requires that,under the moderate guidance of government departments,a pattern of food safety guarantee should be formed with the principle of "object-oriented" as the core of efficient allocation of resources and effective risk control. But at present,as an important role in food safety supervision,the inherent system and operation mode of food industry associations cannot meet the development requirements of multi-social governance in the new environment. Combining with the reform of China' s food safety supervision system,this paper analyzes the apparent and root contradictions contained in the integrated supervision system,and based on the unity of opposites of this group of contradictions,judges the behavior choice of the government and members of trade associations in the process of social co-governance,and then makes suggestions on the construction of the main mode concerning the supervision of food safety under the new situation from many aspects.
