摘要
作为一门法学与语言学的交叉学科,法律语言学的学科定名及内涵等需要进一步思考和建构。根据学理分析了法律语言学与Forensic Linguistics(法庭语言学)字面义及内涵的区别,以及法律语言学与"法律与语言学"(或"语言与法律学")"法律语言研究""语言学法学"及"语言法律学"等的不同,强调以"法律语言"为研究对象的法律语言学一般是或偏于"‘法律语言’学",而Forensic Linguistics(法庭语言学)和新分析法学的研究,则更多的是"法律‘语言学’"。
As an interdisciplinary subject of law and linguistics,the name and connotation of legal linguistics need to be further studied and constructed.This paper analyzes the difference between legal linguistics and forensic linguistics in terms of literal meaning and connotation,and the difference between legal linguistics and "law and linguistics"(or "linguistics and jurisprudence"),"legal language studies","linguistic jurisprudence"and"language and law".Legal linguistics,which takes"the language of the law"as the research object,has a heavier focus on"the study of legal language",while Forensic Linguistics and New Analytical Jurisprudence give more emphasis on"legal‘Linguistics' ".
