摘要
保护外国投资一直是国际投资协定的价值追求与主要内容。随着晚近以来国际投资协定日益丰富,尤其是投资仲裁案件的不断增多,外国投资者依据国际投资协定挑战东道国规制权的现象也日渐凸显。因此,在国际投资协定的条约实践中有关东道国规制权的内容也逐渐增加,其突出体现于国际投资协定的序言、征收条款、例外条款和程序条款之中。中国长期以来积极参与国际投资协定的谈判,对于晚近在协定中增设规制权的做法应当仍予以支持,同时,不必主张所谓的＂身份＂混同而有所不同。
From the relationship between forestry control and ecological civilization construction, the author exposited the idea of forestry pest green management in Jiangxi Province, indicated that green management was important practice of building ecological civilization experimental zone in China. The paper systematically analyzed the current situation of forestry pest control in Jiangxi Province and restrictive factors, proposed the idea and strategy of green management.
