摘要
近些年,专利权主张实体(PAE)迅速崛起,它们借助法律漏洞牟取了不正当的巨额利益。美国国际贸易委员会(ITC)是PAE获利的重要平台之一。按照美国关税法,ITC只能向美国国内产业的申请者提供救济,美国国内产业标准是决定ITC管辖范围的看门人标准。从严解释美国国内产业条款是有效阻击PAE在美国经济体制中蔓延的有力武器。
PAE has been arisen rapidly in recent years and seeking huge dishonest profits by using loopholes of laws. The ITC also becomes one of important platforms for PAE to make profits. According to the Tariff Act, only the entity which has domestic industry could get relief from the ITC. The domestic industry standard is the gatekeeper standard of the jurisdiction of the ITC. At the moment, the broad definition of domestic industry makes the ITC become tools of make profits for PAE. So, explaining the article of domestic industry strictly is a powerful weapon to stop PAE spreading effectively.
