摘要
建设用地涉及诸多法律问题,因专业性强且散见于各种法律、法规和规章的条文中,为行政机关的宏观管理和依法行政带来不便。随着经济的发展和城市化进程的加快,建设用地纠纷会大量出现。针对此,文章从建设用地的依据(规划和"三证")、建设用地的前提(土地的征用和申请)、建设用地的难点(拆迁)和建设用地的诉讼问题等方面进行了通俗和系统的分析。
The construction lands have been covered by many laws, regulations, and guidelines, which, very professional, has led to inconvenience for administration to management. As economy goes ahead and urbanization accelerates, lots of issues regarding construction lands take place. This paper gives a systematical analysis on the basis, preconditions, difficult points and lawsuits regarding construction lands.
