摘要
从著作权领域中著作权人权利实现和公众利益保护平衡的角度来看,在网络时代数字图书馆领域应实行"有限制"默示许可使用制度。通过对当前著作权法中涉及的著作权许可问题进行逐个分析,结合网络时代作品传播的特点,确定解决数字图书馆著作权许可问题的入手点——建立"有限制"的默示许可制度。
From the balance prospectives of the realization of copyrighters＇ interest and the interest protection of the public in the scope of copyright, the paper researches on what license system should be implemented in the digital library in internet ages. Based on the analysis of issues of the present copyrights license system involved in the present copyright laws and in combination with the characteristics of works transmission on the internet, the paper finds the method to solve the problem of copyright license for the digital library, that is, to build the implied license system with restriction.
