摘要
权力应当有所制约 ,这是贯穿刑事诉讼的基本理念。我国侦查机关对于各自权限内的案件 ,有独立的决定权 ,导致侦查讯问在侦查机关单方控制下进行 ,几乎受不到任何制约。刑讯逼供作为司法人员滥用职权的表现 ,正是在这种环境下滋长和蔓延的。制止刑讯逼供 ,关键在于构建一套制约侦查讯问权的有效机制。
It is a basic idea throughout the criminal procedure that power should be restricted. However, interrogation in China is controlled by the investigation organs unilaterally which is hardly believed to be restricted, resulting in that interrogators possess absolute power in dealing with cases. Being a representation of abusing of powers, the inquisition by torture actually develops and extends under such circumstances. It is therefore necessary to establish an efficient mechanism of restricting the interrogatory power so as to prevent the inquisition by torture.
