摘要
肉刑制度是我国古代重要的刑罚制度,是旧五刑的核心内容,也是汉文帝废除肉刑以前历代刑法制度的主要内容。本文从肉刑由形成、发展到废除的整个过程的考察中,对肉刑制度由兴到废各阶段的原因和法文化背景分别进行了深入的探析,并在此基础上得出结论:社会历史背景、统治者的贤明程度和能力以及儒家思想、法家思想和黄老思想的影响等法文化因素,是影响肉刑兴废的主要原因,也是影响和推动我国古代法制发展变迁的主要原因。
The corporal punishment is an important penal system of ancient China and is the core content of old WuXing,and also is the main content of the criminal law system of every dynasties of China before Emperor Hanwu abolished it. From the observing and studying of the whole process of the origination,development and abolishment of the corporal punishment,I have analyzed the reasons and the legal cultural background of corporal punishment of Each stages of the whole process. Based on these analyses,I come to the conclusion:some legal culture has played a very important role in the whole process,such as the social and historical background,the wisdom and ability of the rulers,as well as Confucianism,Legalists thoughts,and the thought of Huang-lao,and these legal cultures have also influenced the development and vicissitude of Chinese ancient legal system.
