摘要生产者延伸责任是法律设定的生产者之角色义务,生产者延伸责任是对现有之生产者环境责任的补足,但与作为承担法定不利后果之产品责任及废物致害责任有着根本的不同。生产者延伸责任的形式包括行为责任、经济责任和信息责任,但其关键在于行为责任和经济责任,其中经济责任往往是行为责任的代履行方式。我国现有法律已经明确了生产者要承担列入强制目录的产品或者包装物在废弃后的回收、利用及处置责任,进一步的立法需要注意根据不同产品类型设定生产者延伸责任实现的不同模式,以及注意生产者在联合履行延伸责任的情况下其个体责任的实现机制。 Extended producer responsibility(EPR) is the legal duty of producers and a complement to current producers environmental responsibility.But it is fundamentally different from product liability and liability for damage caused by waste.The types of extended producer responsibility include behavioral responsibility,economic responsibility and informative responsibility,and the key to it is behavioral responsibility as well as economic responsibility.Economic responsibility is usually a substitute for physical...
