摘要
疫期中后的政府投资活动应当依据政府投资的法律制度进行。2019年发布的《政府投资条例》规定了政府投资的基本制度框架,但是它的重心是对政府投资的项目管理。应当在政府投资条例的基础上进行完善和延伸,逐步形成我国政府投资的全面制度。根据政企投资分离的改革方针和服务型政府的建设要求,以公共服务行政法作为对政府投资活动进行系统性规范的依据,有效控制政府投资的规模,遏制政府投资的非法律理性冲动。
The governmental investment after epidemic shall be conducted in accordance with the law. The Legal Regulation onGovernment Investment(LRGI)issued in 2019 sets out the basic institutional framework for government investment, which morefocus on project management of investment with some general legal requirements. It is necessary to formulate a comprehensive legal institution on governmental investment. This paper proposes that the regulation on governmental investment should be includedin the administrative law on public service in conform to the objective of service-oriented government, so as to effectively curb thenon-legal rational impulse of investment.
