摘要
我国刑事证据法关于证明力审查的规定零乱繁杂,缺乏系统化的理论框架作为支撑,可能出现案件事实认定的偏差。考虑到我国的刑事诉讼制度、证据法规定和法律文化传统,有必要引入“以印证判断为基础,以情理判断为检验”的双层次刑事证明模式,并在《刑事诉讼法》中予以明确,推动构建以证据为中心的刑事指控体系。在双层次模式下,印证判断和情理判断围绕证据证明力展开,两者均属于案件事实认定的基本方式,但判断顺序具有先后位次性,在不同案件中介入比重不同。司法人员应当准确把握证据“关联性”要求,通过分析印证证据之间的先后关系、追溯关键证据的形成过程、最大限度挖掘个体证据蕴含的细节信息、全流程审查证据链条、在连续犯案件中引入相似事实证据等方法,为情理判断提供充分信息支撑,提升案件事实认定的准确性。
The provisions on the examination of probative value in China’s Criminal Evidence Law are scattered and complex,lacking a systematic theoretical framework as support,which can lead to deviations in the determination of case facts.Considering China’s criminal procedure system,provisions of the Evidence Law,and legal cultural traditions,it is necessary to introduce a two-level criminal proof mode based on corroborative judgment and tested by reasonable judgment,and clarify it in the Criminal Procedure Law to promote the construction of a criminal accusation system centered on evidence.In the dual level mode,confirmation judgment and reasonable judgment revolve around the evidential power,both of which are basic ways of determining the facts of a case.However,the order of judgment has a hierarchical nature,and the proportion of mediation varies in different cases.Judicial personnel should accurately grasp the requirement of“relevance”of evidence,and provide sufficient information support for rational judgment by analyzing and verifying the chronological relationship between evidence,tracing the formation process of key evidence,maximizing the exploration of detailed information contained in individual evidence,reviewing the evidence chain throughout the entire process,and introducing similar factual evidence in continuous criminal cases,in order to improve the accuracy of factual determination in cases.
