摘要
本文围绕帮助信息网络犯罪活动罪(帮信罪)展开讨论,着重分析了帮助行为的明确与限定、与其他相关犯罪的区分、及网络中立帮助行为的处罚立场等问题。随着信息网络技术的进步,网络犯罪活动日趋多样化,对帮信罪的认定和处理提出了新的挑战。通过对典型案例的分析,文章探讨了技术支持、广告推广、支付结算等不同类型帮助行为的法律责任,以及如何合理界定和限制网络中立帮助行为的处罚范围,以平衡技术创新与打击网络犯罪之间的关系。文章指出,网络中立帮助行为的处罚应考虑到技术发展的需求,避免对无辜服务提供者的过度规制,同时强调加强对网络犯罪活动的预防和打击,维护良好的网络环境和社会秩序。This article focuses on the crime of helping information network crimes (helicopter crime), with an emphasis on analyzing the clarification and definition of helping behavior, the distinction from related crimes, and the punishment stance on neutral helping behavior in the network. With the progress of information network technology, network crimes are becoming increasingly diverse, posing new challenges to the identification and handling of helicopter crime. Through the analysis of typical cases, the article explores the legal liability of different types of helping behavior, such as technical support, advertising promotion, and payment settlement, as well as how to reasonably define and limit the scope of punishment for neutral helping behavior in the network to balance the relationship between technological innovation and the suppression of network crimes. The article points out that the punishment for neutral helping behavior in the network should take into account the needs of technological development, avoid excessive regulation of innocent service providers, and emphasize the prevention and suppression of network crimes to maintain a good network environment and social order.
