摘要
构建新型“无讼式”农村社区是现代乡村法治化治理体系的现实基础。从“嵌入与自主”的二维分析视角出发,对“无讼式”农村社区建设的逻辑框架和实践路径展开了深入的理论分析与案例审视。研究发现,国家自上而下的法治建设与乡村自主性之间的互动关系是理解乡村“无讼式”建设的关键变量,“无讼式”农村社区建设的理论逻辑不仅要重视“嵌入式”的法治建设,将党建引领的政治性嵌入、法治观念的认知性嵌入、制度重塑的结构性嵌入、行动和技术要素驱动的网络性嵌入融合协调,更要以系统性视角关注乡村社会的自主性关联,通过乡村社区的记忆规约、关系吸纳和规则融贯,实现“无讼”纠纷化解。在实践路径上,应遵循“资源整合、理念同频、制度共振、组织协调”的联动化策略,推动“无讼式”农村社区持续有序发展。不过,作为一种过渡性的法治社区建设形态,还应注重矛盾纠纷化解过程中“嵌入式”与“自主性”的动态均衡,以期真正实现“无讼式”农村社区建设的根本目的。
The construction of a new type of“Non-litigation”rural community serves as the practical foundation for a modern rural governance system rooted in the rule of law.Analyzing and examining the logical framework and practical path of“Non-litigation”rural community building from the two-dimensional perspective of“Embeddedness and Autonomy”,the study reveals that the interplay between top-down legal governance and rural autonomy is a pivotal variable in comprehending the“Non-litigation”construction of villages.The theoretical logic of“Non-litigation”rural community construction not only underscores the“embedded”construction of the rule of law but also emphasizes the“autonomous and self-governed”development of rural communities,which is crucial for understanding village“Non-litigation”building.The theoretical logic of“Non-litigation”rural community construction should focus on both the“embedded”rule of law,integrating and harmonizing political embeddedness led by Party construction,cognitive embeddedness of the rule of law concept,structural embeddedness and system remodeling actions,and network embeddedness driven by technical elements.Additionally,it should attend to the systemic relevance of rural social autonomy and achieve“Non-litigation”dispute resolution through the codification,relationship absorption,and rule integration of rural internal community memory.In the practical path,the strategy of“Resource Integration,Conceptual Homogeneity,Institutional Resonance,and Organizational Coordination”should be followed to foster the continuous and orderly advancement of“Non-litigation”rural communities.However,as a transitional form of community building under the rule of law,attention must also be given to balancing“Embeddedness”and“Autonomy”in the process of conflict resolution,aiming to truly realize the fundamental goal of“Non-litigation”rural community construction.
