摘要
随着区块链技术在我国各领域的推广与应用,我国NFT数字藏品得以迅速发展。由于目前我国数字藏品在法律规范、应用技术、运行平台等方面仍处于发展起步阶段,数字藏品市场运行过程中所形成的数字藏品经济价值也引发了相应的刑事法律风险问题,不论是在数字平台与金融管理领域,还是在“买卖”活动中都容易出现相关的犯罪问题。对此,强化技术基础下的入链前审核,规制数字藏品恶意炒作,推进数字藏品平台标准化建设,加强资金链风险评估将成为当前国内数字藏品刑事法律风险的防控对策。
With the promotion and application of blockchain technologies in diverse fields of China,NFT digital collectibles have developed rapidly.Nevertheless,the development of digital collectibles in China is in its nascent stage,particularly in terms of legal regulations,application technologies,operation platforms,etc.Furthermore,the economic value of digital collectibles generated in the operation course of digital collectibles market has also led to corresponding criminal legal risks,which are likely to trigger crimes relevant to digital platforms,the financial management or"buying and selling"activities.In light of this,it is imperative to rely on technologies to closely scrutinize platforms or collectibles prior to their entry into a blockchain,to regulate the malicious speculation associated with digital collectibles,facilitate the standardization of digital collectibles platforms,and to strengthen the assessment of fund chain risks.
