摘要
《投资便利化协定》的签署是国际投资领域的重要突破,改变了此前投资透明度条款较为混乱分散的局面,整合与细化了透明度规则,对未来透明度规则的制定与透明度义务的实施起到指导性作用,对于国际投资营商环境的改善有着重要作用。为回应发达国家与发展中国家对透明度改革的需求,《投资便利化协定》规定了整体上较CPTPP与CAI更高的透明度要求,但强调发展中国家与最不发达国家的能力建设与过渡期,在义务履行上有较强的灵活性。对标《投资便利化协定》,我国的透明度实践依然存在诸多问题,需要梳理并公开地方投资法律法规与规范性文件、加强通报制度体系建设、提升行政裁定信息公开水平,以高质量履行《投资便利化协定》透明度义务。
The signature of Investment Facilitation for Development Agreement(IFD Agreement)is a breakthrough in international investment.It has changed the situation that the previous transparency provisions in international investment are relatively chaotic and scattered,and has integrated and refined the transparency provisions.Guiding the legislation and implementation of future transparency provisions,IFD Agreement plays an important role in improving international investment environment.In response to the needs of developed and developing countries for WTO transparency reform,the IFD Agreement on the one hand provides higher transparency requirements than CPTPP and CAI on the whole;on the other hand,it emphasizes providing assistance and support for capacity building to developing or least-developed country Parties.Therefore,IFD Agreement has relatively strong flexibility in the implementation of transparency provisions.Compared to the transparency provisions of IFD Agreement,China’s transparency practice still has many problems.In order to solve those problems,China should enhance the ability to public all kinds of investment information by establishing single information portal,improving explanation of law,regulation as well as administrative rulings,and establishing WTO notification system.
