摘要
目的:藏医药是中华医学库中的瑰宝,然而目前我国藏药的资源开发相对滞后以及其知识产权的保护力度仍远远不够。本研究基于专利分析法和SWOT模型分析我国藏药知识产权申报过程中失权的原因,为藏药的知识产权保护提供参考依据。方法:本文以大为全球专利数据库为数据源,对藏药专利文献进行深入分析,从国内藏药专利法律状态进行筛选,进而分析失权专利的主要申请人、技术生命周期以及地域分布情况等多方面阐述了藏药专利发展现状。在专利分析的基础上,利用SWOT模型分析藏药发展的内部优势(S)、劣势(W)、外部机会(O)和威胁(T)并提出相关建议。结果:分析结果显示,藏药专利申请中,失权有279件,专利申请水平亟待提高;失权的藏药专利申请以个人为主,其次为企业,高校和研究机构申请占比较低;2005年前后是失权专利较多的时期,且失权藏药专利申请呈现高度区域性分布特点。其优势为国内专利数量较多,处于世界领先地位;劣势为专利授权率低,藏药专利的有效性和安全性研究有待提高,专利国际化程度低;机遇为国家积极支持民族医药产业发展,藏药的需求量与日俱增;威胁为国际市场的竞争对手具备抢占市场的潜力。结论:藏药的发展应以市场需求和国内政策支持为契机,充分发挥藏药的优势,加大高校等科研单位对苗药科技开发重视程度;针对性解决专利申请的薄弱环节。
Objective:Tibetan medicine is a treasure in the Chinese medical library,but the development of Tibetan medicine resources is relatively lagging behind and the protection of its intellectual property rights is still far from enough.Based on the patent analysis method and SWOT model,this study analyzed the reasons for the loss of rights in the intellectual property declaration process of Tibetan medicine in China,and provided a reference for the intellectual property protection of Tibetan medicine.Methods:In this paper,Dawei global patent database was used as the data source to conduct an in-depth analysis of Tibetan medicine patent literature,screen the legal status of Tibetan medicine patent in China,and then analyze the main applicants,technical life cycle and regional distribution of the patent development of Tibetan medicine.On the basis of patent analysis,SWOT model was used to analyze the internal advantages(S),disadvantages(W),external opportunities(O)and threats(T)of Tibetan medicine development and put forward relevant suggestions.Results:The analysis results showed that 279 patent applications were out of rights,and the level of patent applications needed to be improved.The majority of patent applications were filed by individuals,followed by enterprises,and the proportion of applications by universities and research institutions was relatively low.Around 2005,there were more patents out of rights,and the patent applications for Tibetan medicine out of rights showed a highly regional distribution.Its advantage was that the number of domestic patents was large,in the world's leading position.The disadvantage was that the patent authorization rate was low,the effectiveness and safety of Tibetan medicine patents needed to be improved,and the degree of patent internationalization was low.The opportunity for the state to actively support the development of ethnic medicine industry,and the demand for Tibetan medicine was increasing.The threat was that competitors in the international market had the potential to seize the market.Conclusion:The development of Tibetan medicine should take the opportunity of market demand and domestic policy support,give full play to the advantages of Tibetan medicine,and increase the importance of scientific research institutions such as universities to the development of seedling medicine technology,and address the weak links of patent applications.
