专利侵权纠纷行政裁决案件适用一并审理行民争议制度研究——兼评三起专利侵权纠纷行政裁决引发的行政诉讼案

摘要 行政诉讼一并审理民事争议制度自建立并实施以来未能得到有效适用,特别是在涉专利侵权纠纷行政裁决的行政诉讼中能否适用该制度,一直存在争议。本文以三起专利侵权纠纷行政裁决的行政案件为视角,对一并审理专利侵权民事争议的制度构建,从适用要件、例外情形、裁判形式,以及确认不侵犯专利权之诉的受理要件等方面进行探讨,以期为该制度的适用和完善提供更为有益的思路。尤其是在涉专利行政裁决的行政诉讼中,积极推动一并审理行民争议制度的发展,符合实质性化解矛盾的司法审判导向,有助于防止程序空转,提高审判效率。 The joint trial system for civil disputes in administrative proceedings has not been implemented effectively since it was established.In particular,its applicability in administrative proceedings involving administrative adjudications on patent infringement disputes has been controversial.This study attempts to explore the establishment of the joint trial system for civil disputes in administrative proceedings from the following dimensions:applicable conditions,exceptional circumstances,forms of adjudication,and effect of acceptance conditions for suit on affirmation of no tort of patent rights on this system.Therefore,three administrative cases involving administrative adjudications on patent infringement disputes were examined to provide ideas for the application and improvement of this system.Particularly,in the administrative litigation in respect of patent administrative adjudication,the move to actively promote the development of a system for adjudicating civil and administrative disputes together is in line with the the orientation of judicial adjudication to substantively resolve contradictions,and helps to prevent procedural inefficacy and improve the efficiency of adjudication.
