摘要
在职务犯罪治理视域下,监察监督和检察监督有着各自的规范意蕴,二者之间存在着共性与差异性。从宏观层面来看,监察监督和检察监督均能对公权力起到约束和规范作用,在监督目标上具有一定的同向性。但从微观层面来看,二者的监督对象、监督阶段、监督范围和监督方式均有所不同。当前,监察监督与检察监督的关系也面临着一些困境。在配合关系上,监察监督与检察监督的沟通协调机制仍不够完善。在制约关系上,集中体现为检察监督对监察监督的制约不足。应当重塑监察监督与检察监督的关系,通过进一步完善二者之间的沟通协调机制,加强检察监督对监察监督的制约,平衡二者之间的关系,进而实现职务犯罪的有效治理,推动国家治理现代化纵深发展。
Under the context of job-related crime governance,supervision and criminal prosecution have their own normative implications.At the same time,there are commonalities and differences between the two.From the macro level,both supervision and criminal prosecution can play a role in restraining and regulating public power,and have a certain homogeneity in supervision goals.But from the micro level,the two supervision object,supervision stage,supervision scope and supervision method are different.At present,the relationship between supervision and criminal prosecution supervision is also facing some dilemmas.In terms of cooperation,the communication and coordination mechanism between supervision and criminal prosecution supervision is still not perfect.In terms of constraints,criminal prosecutorial supervision is centrally manifested in the lack of constraints on supervision.Based on this,the relationship between supervision and criminal prosecution must be reshaped.By further improving the communication and coordination mechanism between the two and strengthening the constraints of criminal prosecutorial supervision on supervision,the relationship between the two can be balanced to achieve effective governance of job-related crimes,thereby better promoting the in-depth development of the modernization of State governance.
