摘要
新修订《体育法》第5条首次提出保障公民平等参与体育活动的权利,同时为未成年人、妇女、老年人和残疾人等特殊群体设立了体育参与保障权。体育参与保障权的设置有助于解决当下未成年人、妇女、老年人、残疾人等特殊群体体育权利保障不足,相应体育公共服务供给缺失,体育无障碍环境设置不足等问题,体育参与保障权的设立符合国际体育发展的时代潮流与社会公平正义理论,是贯彻“以人民为中心”法治思想的重要体现,是新时代共同富裕的必然要求。未来在新修订《体育法》实施的背景下,体育参与保障权的实现路径包括:继续完善体育供给服务体系,为特殊主体提供优质、无障碍、均等化的体育公共服务;制定多级联动及多部门协同的政策法规体系,形成操作性强的救济监督机制;针对不同群体制定相应的普法规划,提升全民对体育参与保障权的认知,切实保障特殊主体的体育参与保障权。
Article 5 of the newly revised Sports Law proposes for the first time to guarantee the equal right of citizens to partici-pate in sports activities,and also establishes the right to participate in sports for special subjects such as minors,women,the elder-ly,and people with disabilities.The establishment of the right to participate in sports protection can help solve the current problem of insufficient protection of sports rights for special groups such as minors,women,the elderly,and people with disabilities,as well as the lack of supply of public sports services and the lack of accessible sports environments.The establishment of the right to participate in sports protection is in line with the trend of international sports development and the theory of social fairness and justice,and is an important embodiment of the"people-centered"rule of law,It is an inevitable requirement for common prosperi-ty in the new era.In the context of the implementation of the newly revised Sports Law in the future,the realization path of the right to participate in sports protection includes:continuing to improve the sports supply service system,providing high-quality,accessible,and equal sports public services for special subjects;Develop a multi-level linkage and multi departmental collabora-tive policy and regulatory system,forming a highly operational relief and supervision mechanism;Develop corresponding legal popularization plans for different groups,enhance the public's awareness of the right to participate in sports,and effectively safe-guard the right of special subjects to participate in sports.
