从“接诉即办”透视中国基层之治——基于北京样板的国家治理现代化逻辑阐释 被引量:12

From“Receiving and Handling Complaints Immediately”to the Primary-level Governance of China--Logical Interpretation of State Governance Modernization Based on Beijing Experience

摘要 “接诉即办”是“浦江经验”在北京的生动实践,是“中国之治”在基层的典型案例。对于“接诉即办”改革实践的理解,需要在事实和理论两个层面进行建构。从技艺-人工品的哲学范式理解“接诉即办”的事实,强调“接诉即办”是一个包含着人类偏好、价值、目标和判断的治理人工品,其本体包含客观本体和主观本体,可以划分为物理事实、类型事实和制度事实。考虑到局部和整体之间关系,以及要素与系统之间关系,对于“接诉即办”改革实践的中国基层之治逻辑,可以从党的领导、依法治国、人民民主、全面深化改革、发挥中央和地方两个积极性、推行共建共治、体现人民至上、自我革命等八个方面对其包含的国家治理现代化逻辑进行阐述。将“接诉即办”与“中国之治”联系起来,既可以更好对作为地方治理实践的“接诉即办”改革有深刻洞见,又可以加深对中国国家治理现代化逻辑更多的实践认知。 Understanding the reform practice of“Receiving and Handling Complaints Immediately”needs to be constructed at the two dimensions of facts and theories.From the philosophical paradigm of artisanshipartifact,this paper emphasizes that“Receiving and Handling Complaints Immediately”is a governance artifact containing human preferences,values,goals and judgments.As for the facts,there are two type of facts,namely objective ontology and subjective ontology,which can be divided into physical facts,typology facts and institutional facts.Considering the relationship between the part and the whole,as well as the relationship between the elements and the system,we study the reform under the overall background of“Governance of China”.The logic of“Governance of China”in the reform practice of“Receiving and Handling Complaints Immediately”can be expounded from eight aspects:the leadership of the party,the rule of law,people's democracy,the logic of comprehensively deepening reform,giving full play to the enthusiasm of the central and local governments,promoting co-construction and co-governance,reflecting the supremacy of the people and party's self-revolution.Linking“Receiving and Handling Complaints Immediately”with“Governance of China”can not only have deeper insight into the reform of“Receiving and Handling Complaints Immediately”as a local governance practice,but also deepen the practical understanding of the logic of China's state governance modernization reflected at the empirical level.
