摘要
《著作权法》第53条第(六)项与《刑法》第217条第(六)项规定的内容均涉及规避保护技术措施行为的刑事责任问题。其中,《刑法》第217条第(六)项存在限缩规制规避行为类型,无法规制帮助规避保护技术措施行为,以及极易陷入“刑优于民”或“刑不依赖民”的不平衡困境。《刑法》之款项看似在“优化”,但实际上仍未解决问题。为解决规制规避保护技术措施行为入罪的刑民统一性问题,需正视《刑法》与《著作权法》在保护技术措施价值取向上的差异,强调《著作权法》是《刑法》将规避保护技术措施行为入罪的规范基础,入罪须建立在《著作权法》相关概念基础之上,同时要综合考虑规制规避保护技术措施行为的目的、入罪条件及其法定例外情形等方面。
Article 53(6)of Copyright Law and Article 217(6)of Criminal Law in China both involve the provisions of criminal liability for circumventing technical measures of copyright protection.However,Article 217(6)of the Criminal Law of the Criminal Law has a type of limited regulation behaviors,which cannot be used to help avoid the behavior of technical measures,and it is easy to fall into the unbalanced dilemma of Criminal Law is superior to Copyright law or Criminal Law does not depend on Copyright law.The Article 217(6)of the Criminal Law seem to be optimized,but in fact,the problem remains unsolved.In order to achieve the connection between Criminal Law and Copyright Law in regulating the evasion of technical measures,it is necessary to face squarely the differences in the values of technical protection measures between the Criminal Law and the Copyright Law,and emphasize that the Copyright Law is the normative basis for criminalizing the evasion of technical measures in the Criminal Law,and criminal criminalization should be based on the relevant concepts of the Copyright Law.At the same time,the purpose of regulating evasive behavior,criminal conditions and legal exceptions of evasive behavior should be considered comprehensively.
