摘要
作为程序性行政行为的行政复议中止本应对保障行政复议的良好运行起到积极作用,然而复议机关作出的中止决定,有时会使行政纠纷难以及时解决。行政复议中止行为的滥用和复议机关内部监督的缺位,要求行政复议中止行为具有可诉性。成熟原则、国家权力配置功能适当原则以及行政复议中止行为自身所具备的救济制度的特性,为司法机关介入提供了理论支撑,要求司法机关应当对行政复议中止行为的合法性进行审查。行政复议中止行为的可诉性应当满足基础标准、事实终局标准与实际权益影响标准。
As a procedural system,the suspension of administrative reconsideration was initially designed as a safeguard system for administrative reconsideration.However,due to the imperfect legal regulation,the suspension of administrative reconsideration leads to the long-term uncertainty of the disputed rights and obligations.In many cases,the suspension decision made by the reconsideration organ makes it difficult to resolve administrative disputes in a timely manner.The abuse of the suspension of administrative reconsideration and the absence of internal supervision of the administrative organ over the reconsideration mechanism in the practice of administrative reconsideration require that administrative reconsideration be actionable.The principle of maturity,the principle of appropriate allocation of state power and the characteristics of the relief system possessed by the suspension of administrative reconsideration provide a theoretical support for the intervention of the judicial authority,which requires the judicial authority to review the legitimacy of the suspension of administrative reconsideration.Based on this,the paper puts forward the standards for the actionability of the suspension of administrative reconsideration,that is,the basic standard,the final standard of facts and the standard of actual rights and interests.
