摘要
安全生产监管执法是政府督促企业降低安全风险、消除事故隐患、提高安全生产水平的重要行政手段,也是政府安全生产监管政策的具体体现,但目前尚缺乏对于安全生产监管执法更加系统化、标准化的普适性评估机制。针对安全生产监管执法工作,梳理执法工作流程,从执法模式和执法效果两方面设计评估机制,建立评估指标及模型,确定评估要点,对执法模式的合规性及执法结果的有效性进行评估,建立了一套客观分析政府安全生产监管执法工作模式和效果的安全生产监管执法评估机制。在某省对该机制进行了有效的实证应用,评估了该省异地执法工作的合理合法性,并提出了改进执法工作和促进该省安全生产监管工作的意见建议。
The regulatory law enforcement of work safety is an important administrative means for governments to urge enterprises to reduce safety risks,eliminate potential accidents and improve the level of work safety.It is also the concrete embodiment of governments’work safety supervision policy.Therefore,it is necessary to establish a scientific and reasonable evaluation mechanism based on the basic principles of government policy evaluation.Given work safety supervision law enforcement,this paper designs an evaluation mechanism from two aspects of law enforcement mode and enforcement effect.It can evaluate the compliance of different law enforcement modes and the effectiveness of the results,and make an empirical application in a province.This paper determines the object and index of the evaluation of the law enforcement mode of government work safety supervision and combs the law enforcement process of the six steps and sixteen indexes of the law enforcement of work safety.The index of“absolute deviation rate of inspection team”is introduced to calculate the weight from the two aspects of the accuracy rate of hidden danger inspection results and the missing rate of on-site disposal methods,which is used as the weight adjustment element of“administrative law enforcement”step-index to strengthen the evaluation of the rationality and effectiveness of administrative law enforcement results.It establishes the quantitative evaluation model of the law enforcement process and the three-stage eleven-step evaluation process.It puts forward the key points of the evaluation implementation and suggests that sampling survey and in-depth interview be selected as the main evaluation methods.The establishment of an evaluation mechanism can scientifically and objectively analyze the government work safety regulatory law enforcement.Besides,it provides legal and reasonable suggestions for the innovation of law enforcement mode.Moreover,the evaluation mechanism can be used for different types and levels of work safety supervision and law enforcement,and can objectively reflect the effectiveness and applicability of various law enforcement modes,as well as the law enforcement ability and level of law enforcement teams at all levels.
